What must you know about the Visa for your future Russian wife? Fiancee Visa Preparation and Information.If your fiancee is not a citizen of the United States and you plan to get married in the United States, then you must prepare a petition and file it with USCIS on behalf of your fiancee. After the petition is approved, your fiancee must obtain a visa issued at a U.S. Embassy or consulate abroad. The marriage must take place within 90 days of your fiancee entering the United States. If the marriage does not take place within 90 days, your fiance(e) will be required to leave the United States. Until the marriage takes place, your fianc?e is considered a nonimmigrant. A nonimmigrant is a foreign national seeking to temporarily enter the United States for a specific purpose. A fianc?e may not obtain an extension of the 90-day original nonimmigrant admission. Your fiancee may enter the United States only one time with a fiancee visa. If your fiancee leaves the country before you are married, your fiancee may not be allowed back into the United States without a new visa. This is what is required for you to be able to file a petition using the K-1 process: You must be a US citizen. Permanent residents of the U.S. are not allowed to obtain Fiancee visas. Both you and your Fiancee must be free to marry. If either of you have been previously married, you will have to be either divorced, widowed, or had your marriage annulled. You must have met your Fiancee in person within the previous two years. Since it is almost impossible to obtain a visitor visa to visit the U.S., this means that you must go to her country to meet, or arrange to meet in another country. You must meet the minimum income requirement for the fiancee visa petitioner. The fiancee visa can be quite complex and must be prepared accurately. If there is just one little mistake, it can set back your application for many months. Since September 11, many immigration laws have changed and there is more scrutiny than ever before. |
